Kelsey O’Day trial rescheduled

The trial for Kelsey Lee O’Day, 27, of Friday Harbor, has been rescheduled for 9 a.m., Monday, April 16 in San Juan County Superior Court. The original date was March 14.

O’Day pleaded not guilty to child rape in the third degree with a teenage boy on Dec. 14.

In Washington, child rape in the third degree is defined as when the person has sexual intercourse with another who is at least 14 years old but less than 16 years old and not married to the perpetrator and the perpetrator is at least 48 months older than the victim.

The omnibus hearing is scheduled for March 23 and the pre-trial hearing is scheduled for April 6.

O’Day was charged with three counts of child rape in the third degree on Nov. 16. This is a class C felony, which carries a maximum sentence of five years.

The parents of the minor in this case reported the alleged crimes to law enforcement on Nov. 3. The alleged sexual encounters occurred on Oct. 23, 29 and 30, when the minor’s father was out of town. O’Day knows the father and son.

Shortly after being charged on Nov. 16, O’Day went to Mexico, even though there was a warrant issued for her arrest. No additional charges were filed against her for leaving the country.
